Property Across the Road

We considered our option to purchase this lot, but we concluded that we did not have clarity to purchase it.

The property was purchased on 1/3/23 by a Michael Malone. Michael Malone has applied to the Board of Adjustment to operate a “specialized firearm repair, modify, design, build business …. To purchase and to manufacture & deal in Title II firearms.”

The ZBA hearing will be Wednesday 2/22/23 7PM.

Title II firearms pertains to machine guns, short or "sawed-off" shotguns and rifles, and so-called destructive devices (including grenades, mortars, rocket launchers, large projectiles, and other heavy ordnance).

There are covenants in a previous deed that state: “A quiet atmosphere shall be maintained on the property. There shall be no use of noisy equipment for outdoor recreation such as loudspeakers, amplified music, or motorized recreational vehicles. Commercial use shall preclude activities that would disturb the quiet of the neighborhood.”

One might think that that covenant settles the matter, but deed covenants can be challenging to enforce. It is further complicated because that covenant does not appear in the deed Michael Malone received.

Lucy has passed on some documents related to this matter to Rich, and Rich has collected a few more. Presumably we will want to prayerfully meditate on this in our Meeting for Business. In the meantime, Rich would be happy to work with other volunteers to consider possible responses.
